Family Dispute Resolution (FDR)

At National Family Mediation Solutions, we understand that parenting and property disputes can be complex and emotionally charged. Our team of experienced mediators are dedicated to guiding you through the resolution process, providing a constructive and impartial approach to finding a satisfactory outcome for all parties involved.

Child focused and Child Inclusive Mediation

At National Family Mediation Solutions we give the children a voice and provide an opportunity for them to be heard in our child inclusive mediation. This child focused approach has been designed to allow parents to hear and consider meaningfully what their child or children have to say in regards to their relationship with each parent or carer and what the resolution dynamics might look like for them going forward.

Property and Financial Disputes

Mediation services are available to discuss the division of assets and debts, child support, and spousal maintenance following separation from a spouse or de facto partner.

We offer mediation for both either represented and self-represented parties.

In accordance with the Family Law Rules, prospective parties are required to make genuine attempts to resolve financial disputes before initiating court proceedings. Family Dispute Resolution (FDR) serves as an essential step in this process.

Our FDR service supports self-represented parties through mediation, facilitated by a legally qualified mediator. This service includes:

– Comprehensive intake sessions designed to enhance parties’ understanding of the legal framework within which they will make decisions

– Clarification of disclosure obligations

– Preparation for property mediation

– Referrals to relevant professionals, including lawyers, accountants, mortgage brokers, valuers, and other experts as needed

– Guidance on fulfilling obligations to take genuine steps in the resolution process

We assist clients in this process by preparing comprehensive Heads of Agreement.

If an agreement is reached, it can be formalised by:

  • A Binding Financial Agreement, or
  • Applying to the Family Court or Federal Circuit Court of Australia for Consent Orders.
